The World Company World S.à.r.l. aims the sale of products or any other brand TUKI artice sold by The World Company S.à.r.l.

Any order placed by a customer on the www.tukifruits.com website constitutes acceptance of these terms and conditions by the customer.

Article 3: Purpose

These Terms and Conditions set out the contractual relationship between The World Company S.à.r.l. and its customers. The Terms and Conditions set out the rights and obligations of the parties for the duration of the relationship between The World Company S.à.r.l. and its client.

The Company World S.à.r.l. reserves the right to modify at any time these terms and conditions without prior notice. Terms and conditions are available at any time on www.tukifruits.com and the online version will prevail, if any, on any other version. These Termsand Conditions will remain in effect until a new version is available on our website, it is why before checkout the customer must consult the Terms and Conditions and confirm to have read them.

These Terms and Conditions apply, without limitation or qualification to all products offered for sale by The World Company S.à.r.l. on its www.tukifruits.com website.

Article 4 : Products

All products offered on the www.tukifruits.com website meet safety, food safety and hygiene standards and comply with the legislation in application in Luxembourg and the European Union.

The consumer is free and responsible for their purchases on the website.

All products sold on this website are presented with the utmost care. Photos, illustrations, descriptions and characteristics are chosen in order to better inform the customer about the product. Nevertheless, photos and illustrations are not binding.

All items presented on www.tukifruits.com are in stock to guarantee optimal delivery deadlines.

In case of out of stock, information regarding this break will be mentioned on the website and the customer will not be able, technically, to order the product concerned or the customer will be informed by email. The customer can choose between delivery of the initial order at a later date, taking into account the replenishment lead time, or a full refund of the order.

The customer remains solely responsible for any purchase not adapted to their needs and tolerances. In no case, shall the responsibility of The World Company S.à.r.l. can not be engaged.

In the particular case where the required information present on the label at consumer's disposal would not be in the language(s) of the country of destination of the order, The World Company S.à.r.l. commits to provide you with this information in the form of a paper document, together with your order.

Our responsibility will not be engaged in case of non-compliance with the legislation of the country where the product is delivered, it is your responsibility to check with local authorities the possibilities of importation of the products offered.

Article 5 : Price

All prices indicated on our website are in euros and do not include shipping.

The price for delivery, itself expressed in euros, will be displayed after you have defined your delivery address and the chosen delivery method that suits you (home, office or relay point for the countries concerned) in the tunnel control before the final checkout and payment. We also defined free of charge thresholds for each of the destinations. We invite you to visit our "Shipping" page for specific conditions associated with your country.

Basicly on the website, all prices shown are inclusive price (including taxes). Thus, for the orders to EU, prices include the VAT and the end customer will not have additional cost involved appart from the delivery charges in case of the order doesn't reach the free of charge threshold. Any change of VAT rate will be reflected in the price of products.

For orders to a country outside the European Union, prices will become off-VAT after entering your shipping country in the order tunnel. Shipping fees (if you have not reached the free of charge threshold) and any customs fee, VAT or other taxes relating to your country will be taken in charge by yourself. It is the customer's responsibility to check with local authorities and to support the charges.

The products ordered will be billed based on prices in effect on the website at the time of recording of the order. The ordered products remain the property of The World Company S.à.r.l. until receipt of the entire bill. We reserve the right to suspend or cancel any order for non-payment of any amount payable by the customer.

Selling prices of the different products may change at any time without notice depending on the pricing policy implemented by The World Company S.à.r.l.

Article 6 : Identification on the website

At the time of placing the order, the customer will be asked to identify himself with their email address and their password, if he has already a client account on www.tukifruits.com or to create an account, if he does not have already an account. For the validation of the order, you guarantee us to have the necessary permissions to use the payment method you choose.

We certify that the credit card details are encrypted using SSL (Secure Socket Layer) protocol and are never transmitted unencrypted over the Internet. Payment is made directly to the bank. At no time, we are aware of your credit card numbers.

Article 9: Delivery

To ensure the best possible service to our customers, we have chosen to offer home delivery and also delivery in relay points for the countries in which we have chosen the opportunity to propose and to use this service.

To provide you with fast delivery, we will confirm that all the items offered on our website are in stock. All orders placed before 12am and paid by credit card will be dispatched the same day.

You can find the in the "Delivery" section of the e-shop, the list of delivery means, times and costs that we offer depending on the country in which you wish to be delivered. For each destination, we determined a threshold of free of charge depending on the amount of your cart and the shipping method chosen.

Delivery times are provided for guidance and any overshoot will not give rise to damages or to withholding or cancellation of an order from the customer.

Deliveries are made by professional parcel operators. Under normal circumstances, the parcel service ensures delivery between 1-3 working days to all countries served. The World Company S.à.r.l. will not be held responsible if delivery times exceed the time limits in circumstances that are beyond its control.

The customer must provide a valid shipping address (PO Box addresses are not accepted) when ordering on the online shop and ensures that an authorized person is available to receive the delivery and sign the delivery receipt at the time of arrival of goods at the delivery address. Delivery delays or unsuccessful delivery attempts can cause perishing of perishable goods, for which The World Company S.à.r.l. can not accept any responsibility.

Article 10: Delivery not compliant with the order

If a defective product was delivered to you at home or relay point, it should be reported immediately to the carrier or relay point. You are perfectly entitled to open the package in front of the carrier or relay point and refuse it if the content of the package is damaged.

In this case, the package will be returned by the carrier, we will see the damage, will call our insurance and will resend a new package as soon as possible.

As mistakes are possible, it is possible that one of our preparers makes a mistake in the composition of your package or one of our suppliers or service provider has provided us with an item with a manufacturing defect.

If a non-perishable and non-conforming product to your order was shipped to you and you would like to return, we promise to take you to an exchange or, where appropriate, to offer a credit or refund.

We ask you to contact us within 2 days after receipt to notify us of this not conforming order delivery. After this period, we will consider that you have confirmed the compliance of the delivery with your order.

In case of defective or non-conforming non-perishable product, we commit to send you a return label so we can take care of the cost of returning the parcel. Any new postal dispatch will also be at our expense.

Here is the procedure to be followed in this case:

As soon as you notice a defect or non-conformity of a product, we ask you to send us an email to hola@tukifruits.com as soon as possible. For efficient processing of your application, please indicate in your message your surname, your first name, customer number and your order number. In your message, we ask you to explain as clearly as possible the reason for your return request. Feel free to attach pictures if you deem it necessary. More accurate your message will be, quicker will be our response time.

Any anomaly concerning the delivery must be indicated on the delivery note and be accompanied by the signature of the customer.

Upon receipt of your email, we will process your request and send you a return number and a label for the return transport.

Upon receipt of the return number and label, please prepare the return package stating your return number on a sheet inside the package.

Items must be received in the same condition as when you received them, that is to say, in their original packaging. Modified, incomplete, damaged, soiled received Items, or not with their accessories and original labels will not be accepted for return.

If a perishable and non-conforming product to your order was shipped, we commit to send you the correct command, fully or partially, depending on the mistake. We can also offer you a credit or refund of the order on the basis of the price paid according to mistakes made.

We ask you to contact us within 2 days after receipt to notify us of this not conforming order delivery. After this period, we will consider that you have confirmed the compliance of the delivery with your order.

Upon receipt of your email, we will process your request and we will contact you by email, then, if necessary, by phone.

In case of proven, repeated and/or perceived abuse by the customer, we reserve the right to not contract thereafter therewith.

If we consider that there are known or suspected abuse to a contentious command in progress for an amount that we believe fairly high (above 100 EUR) we reserve the right not to respond favourably to the customer complaint .

Article 11: Right of withdrawal

For non-perishable products, in accordance with European regulations, we give our customers a withdrawal period of 15 days from the date of order delivery.

To apply your right to cancel, we ask you to send us an email to hola@tukifruits.com so that we can send you a return number to be indicated on a paper sheet inside your return parcel.

Any return parcel without return number will be refused and we disclaim any responsibility for the parcel.

This right of withdrawal is without penalty, except the cost of return transportation. The customer will have the option of requesting either a credit note on your next purchase or refund items (one way shipping deducted) or an exchange (return postage borne by the customer).

For non-perishable products (food), in accordance with European regulations, we can not give our customers the withdrawal period.

Article 12: Our newsletter

We regularly send e-mailing campaigns to our customers to keep them informed about news on our products, our news and promotions from our e-shop.

As soon as our customers create an account on our website, we automatically add them to the mailing list for our newsletter. If you do not wish to receive it, please click on the unsubscribe link at the bottom of each of our newsletters. This deregistration will be effective immediately.

Article 13: Protection of privacy and personal data

All personal data collected by The World Company S.à.r.l. in the frame of business with customers will be included in its files and will only be used for specific context defined by the contract between the two parties. Pursuant to the Luxembourg law of August 2, 2002 (transposition of the European Directive 95/46/EC of 24 October 1995) on the protection of privacy with regard to the processing of personal data, the client has the right to consult and rectify the data in question as appropriate.

Article 14: Applicable law and competent court

Any dispute between The World Company S.à.r.l. and its customers shall be governed by Luxembourg law from the fact that the headquarters of The World Company S.à.r.l. are located in the Grand-Duchy of Luxembourg.

In case of dispute, the parties shall endeavor to resolve the dispute amicably. Failing such agreement, the courts of Luxembourg shall have exclusive jurisdiction.

If one or more stipulations of these terms are held to be invalid or declared as such under any law, regulation or following a final decision of a competent court, other stipulations shall remain in full force and scope.

In case of discrepancies or disputes, the French language version of these Terms and Conditions apply.
